Terms & Conditions
These are the terms and conditions on which we have agreed to provide the Products to you.
1. Acceptance of Terms and Conditions
1.1 You agree that
(a) This Agreement applies to all purchases of Interior Warehouse Products from the Interior Warehouse website ("Site”) and, further, that each time you access the Site you are deemed to have read and understood these Terms and agree to be bound by them;
(b) We may vary these Terms from time to time and you agree that the Terms (as varied) will apply from the date the updated Terms are posted on the Site.
(c) It is your responsibility to check the Site regularly for any variation to the Terms.
2. Information
2.1. You warrant that any information you provide when registering on the Site, or at any time after that, is true, accurate and complete in all respects and, further, that you will make amendments to this information as required from time to time to ensure it remains true and correct.
2.2. You further warrant that the information you provide will not be misleading, deceptive or likely to mislead or deceive.
3. Privacy Policy
3.1. Interior Warehouse is bound by the Privacy Act 1993. Any personal information that INTERIOR WAREHOUSE collects from you, that personally identifies you, will not be provided to third party organizations without your consent. It will only be provided to third parties where we have your consent to share the information in accordance with these Terms and Conditions, and where we may need to share your information in order to provide the Product that you have requested.
3.2. You can have access to the personal information that we hold about you and, if required, you can request that your personal information be amended.
4. Online Security
4.1.INTERIOR WAREHOUSE use the services of Direct Payment Solutions Limited (DPS), who offer a direct payment gateway. DPS processes on-line credit card transactions securely, providing a safe and secure online payment service. INTERIOR WAREHOUSE does not collect or store any credit card information. This information is all processed by DPS. When making a purchase you will be directed to a secure webpage hosted by DPS to enter your payment details. The DPS hosted payments page is secured using SSL (Secure Sockets Layer). SSL is a method of ensuring that information submitted through our website is secure and cannot be accessed by unauthorized users. For more information please read the DPS privacy policy.
5. Price & Ordering
5.1. Product prices quoted on our website are in New Zealand Dollars and are inclusive of GST. You must pay us the full price quoted.
5.2. We reserve the right to vary our prices without notice.
5.3. Product prices are quoted inclusive of any transportation costs, and are subject to change without notice. Any extra courier, handling or transportation charges in relation to your order will be notified to you at the time you place your order and will be added to the price. Risk in INTERIOR WAREHOUSE Products passes to the purchaser on delivery of the Products.
5.4. All products priced as seconds have a no return or refund policy and are sold illustrated.
5.5. Due to the swift nature of our dispatching process, you have 24 hours from placing your order to notify us of any changes or cancellation.
6. Payment Terms
6.1. You must pay us in full, by credit or debit card, at the time that you submit your order on our Site.
6.2. We reserve the right to recover any Products for which you have not paid in full.
6.3. Title passes on delivery of the Products to the purchaser and on receipt by INTERIOR WAREHOUSE of payment in full.
7. Delivery Terms
7.1. You acknowledge all published or communicated delivery dates we provide are estimates only, and that we will endeavour to deliver your product as close to our delivery date as possible.
7.2. You agree to inspect the product packing for damage at the point of delivery, and note any damage on the shippers delivery note before signing and accepting the goods. If any defect or discrepancies are discovered with your order you must notify us within 72 hours of delivery. We are unable to replace or refund any items if we are not notified within this timeframe.
7.3. Please notify our customer service of your issue by Email customercare@interiorwarehouse.co.nz Include a brief explanation and image/s for us to discuss a repair, a replacement or a refund. All of which are wholly determined by, and are at the sole discretion of, INTERIOR WAREHOUSE.
8. Returns
8.1. No returns, refunds, credit notes, replacements or repairs will be made for any items sold as seconds.
8.2. Should you have a change of mind following delivery, please notify our customer service team of your return by Email customercare@interiorwarehouse.co.nz .Please note this must be within 7 days of receipt of your purchase. We are unable to provide you a credit note if you fail to email notification within this timeframe.
8.3. Please pack and return your item in its original and unused condition, along with your completed returns form (we will email you this along with any further instructions). Items not returned in their original packaging or without the completed returns form will not be accepted.
Please note:
(a) We do not offer a free returns service;
(b) With any goods returned you will be credited the purchase price less our original delivery charge determined by us;
(c) Any credit note/s issued on your account will expire within 6 months of being issued;
(d) No cash refund will be offered;
(e) You are responsible for returning your purchase and any costs this involves. Any items which arrive back broken due to insufficient packaging will not be credited;
(f) When returning your purchase you must obtain proof of postage, we are not liable for items damaged or lost in transit;
(g) All returns must be received by INTERIOR WAREHOUSE within 14 days from receipt of delivery to qualify for a credit note.
9. No Warranties
9.1. You agree:
(a) That your use of the Site is at your own sole risk and that any warranties or conditions which may be implied by law are expressly excluded to the maximum extent allowed;
(b) That the content of any advertisements which appear on the Site is solely the responsibility of the advertiser and we do not warrant the accuracy or reliability of such content or the services or products offered by any advertisers;
(c) That we do not warrant that your use of the Site will be uninterrupted, timely, error free and secure, and we are not responsible in any way if the Site is unavailable or for any loss that you suffer as a result of use of the Site;
(d) That we are not responsible for the content of any linked site and do not imply any endorsement of such sites.
10. Your obligations
10.1. You agree:
(a) To comply with our Guidelines;
(b) Not to register as a member of the Site under more than one name, or be under the age of 18 years;
(c) To keep your login name and password as strictly confidential and not to provide this information to any persons under any circumstances;
(d) That any information about you which has been provided to us may be used by us at any time for any purposes connected with the Site including but not limited to internal research, to enforce these Terms, for marketing the Products and any other services which we may offer from time to time, to you. You authorise us to provide such information to any external agency or any party for credit information and assessment purposes and that such agency or party are hereby authorised to use and continue to use such information as part of their business services;
(e) That we may offer third party products and services to you from time to time;
(f) Under the Unsolicited Electronic Messages Act 2007, you consent to receiving commercial emails from us. The email address for unsubscribing to commercial emails is admin@interiorwarehouse.co.nz.
(g) Not to do:
(i) Anything which may prejudice or damage our goodwill, reputation or image, or that of the Site, or our intellectual property;
(ii) Attempt to decipher, decompile, dissemble or reverse engineer any of the software that makes up all or part of the Site.
11. Intellectual Property
11.1. You acknowledge and agree that we own (or have a licence to use) all proprietary and Intellectual Property Rights associated with the Site and its content. This includes all information provided by us and contained on the Site and all graphics, images, logos and other material which forms part of the Site. You must not download, copy, transmit or replicate (using any means) this material.
11.2. That any information you provide to us and which is displayed on the Site does not breach the Intellectual Property Rights of any person.
12. On-line Product Availability
12.1. INTERIOR WAREHOUSE will use every effort to keep an adequate inventory of Products offered on its website. However, all Products sold are subject to their availability. This changes daily and is not guaranteed.
12.2. If INTERIOR WAREHOUSE is unable to supply Products in the quantities specified in your purchase, the buyer will be notified accordingly by email or telephone. If this is the case, any amount charged to your credit card, including delivery charges (if applicable) referred to above, will be refunded as soon as possible
13. Termination
13.1. We can terminate or suspend your access to the Site without entering into any discussions with you.
14. Indemnity
14.1. You agree to indemnify us and keep us indemnified in respect of any damage, loss, costs and expenses (including legal costs on a full indemnity basis) which we may incur as a result of your use of this Site and a breach by you of these Terms, including any claims made by third parties.
15. No Liability
15.1. You agree that under no circumstances are we liable to you in contract, tort (including negligence) or otherwise to compensate you for any loss, injury or damage (whether consequential or inconsequential or otherwise) arising from your use of the Site or the Products.
16. General
16.1. You agree that:
(a) We are not responsible for our inability to comply with these Terms where the same is as the result of a cause beyond our control;
(b) We will not be prevented from enforcing any of our rights under these Terms because on an earlier occasion we did not enforce those rights;
(c) While you are not entitled to assign your rights under these Terms, we may;
(d) We may issue any proceedings in respect of these Terms in any court that suits us. This website may be accessed in New Zealand and throughout the world. The law that governs these Terms is New Zealand law.
(e) We may in our sole discretion vary these Terms from time to time by notice to you.
(f) Any provision of these Terms that is held to be invalid or unenforceable for any reason shall be severed from and shall not affect the remaining provisions of these Terms;
(g) These Terms express the entire understanding between us and that there have been no representations made by or on behalf of us that have been relied upon by you that are not contained in these Terms;
(h) That you are not our agent, employee or partner and are not authorised to represent us or the Site in any capacity.
17. Consumer Guarantees Act 1993
17.1. Where you are acquiring the Product for the purpose of carrying on a business, then the provisions of the Consumer Guarantees Act 1993 shall not apply.
17.2. Where you are acquiring the Product for the purpose other than a business, then these Terms and Conditions shall be interpreted subject to your rights under the Consumer Guarantees Act 1993.
17.3. In the event of a defective or damaged Product being delivered and you wish claim under the Consumer Guarantees Act 1993, you must return the defective or damaged Product to our on-line store as soon as practicably possible, together with proof of purchase.
18. Meaning of Terms used in this Agreement
"Agreement” means this agreement as varied from time to time.
"Guidelines” means any rules or guidelines we may provide you from time to time in relation to using the Site and the Products.
"Information” means all information supplied by you to us via the website, including your name, contact details, credit card details and your payment history.
"Intellectual Property Rights” means copyright, patents, designs, trademarks, trade names, trade secrets, confidential information and any other intellectual property right.
"Products” means all Products available for purchase on our website.
"Site” means the website located at www.interiorwarehouse.co.nz which is owned by us.
"Terms” means these terms and conditions as varied from time to time.
"We” "Us” means INTERIOR WAREHOUSE Limited and its successors and assigns.
"You” means any person who uses the Site and purchases the Products.
